Open Public Will
It is a highly personal, revocable, and free act by which a person clearly and unequivocally expresses their will to a notary. The notary then drafts the clauses of the will in writing, strictly adhering to the testator’s wishes.
REQUIREMENTS FOR DRAFTING A WILL
REGARDING THE TESTATOR:
- Valid official identification containing a photograph, signature, and, if applicable, address
- CURP (Unique Population Registry Code)
- Updated tax status certificate (no older than 3 months)
- Proof of address
- Birth certificate
- Email address
- Phone number
- Occupation
- Original deeds of the real estate properties to be bequeathed
NOTES:
It should be noted that, if requested by the applicant or the Notary, two witnesses must be present at the time the will is granted. These witnesses must not be:
- Employees of the Notary
- Individuals under 16 years of age
- Persons who are not of sound mind
- Blind, deaf, or mute individuals
- Heirs or legatees; their descendants, ascendants, spouse, or siblings
- Persons convicted of perjury
In addition, the following information and documents are required from the witnesses:
- Valid official identification containing a photograph, signature, and, if applicable, address
- CURP
- Occupation
- Place of birth (according to the birth certificate)
