Exchange (Barter)


It is a contract by which each of the contracting parties undertakes to give one thing in return for another.

REQUIREMENTS FOR THE EXCHANGE OF PROPERTIES

REGARDING THE PARTIES:

INDIVIDUALS:

  • Valid official identification with photograph, signature, and, if applicable, address
  • CURP (Unique Population Registry Code)
  • Updated tax status certificate (not older than 3 months)
  • Birth certificate
  • Marriage certificate (if applicable)
  • General information:
  • Full name and general details of the associated parties
  • Marital status
  • Occupation or profession
  • Date and place of birth
  • Current address
  • Email address
  • Phone number
  • If acting through a power of attorney, the original or certified copy of the power of attorney.

LEGAL ENTITIES:

  • Certified copy of the company’s articles of incorporation with registration details in the Public Registry of Commerce.
  • Certified copies of subsequent assembly minutes where amendments to the bylaws were made, duly registered in the Public Registry of Commerce.
  • Certified copy of the deed containing the power of attorney of the company’s legal representative.
  • Updated tax status certificate (not older than 3 months).
  • Proof of address (utility bills or bank statements not older than 3 months from their issuance date, or a valid lease agreement registered with the tax authority).
  • Company address, including:
  • Street, avenue, or road
  • Exterior number
  • Interior number (if applicable)
  • Neighborhood or urbanization
  • Territorial demarcation, municipality, or political division
  • City or town
  • State, province, department, or political demarcation
  • Postal code
  • Country

AUTHORIZED REPRESENTATIVES:

  • Deed proving their legal capacity
  • If the representative of any of the parties involved in the exchange is a foreigner, they must additionally provide the immigration document proving their legal stay in the country and a valid passport.

REGARDING THE PROPERTIES:

  • Property deed(s) of the property(ies) to be exchanged, duly registered in the Public Property Registry (original or certified copy).
  • If the deed covers only a plot of land and constructions were built subsequently, additionally provide construction licenses, official alignment and number, and notice of completion of construction.
  • Up-to-date property tax payment.
  • Up-to-date utility payment receipts (electricity and water, if applicable).
  • If the property is the primary residence of the individual and is exempt from income tax, to qualify for the exemption, one of the following documents must be provided:
  • Voter ID issued by the IFE or INE.
  • Tax receipts for payment of electricity or fixed-line telephone services.
  • Bank statements or statements from institutions within the financial system.
  • Statements issued by commercial entities (e.g., Liverpool, Sears, etc.).
  • The receipts must be the most recent and must be in the name of the transferor, their spouse, or their direct ascendants or descendants.
  • In all cases, the address on the receipts must match the address of the property being transferred.
